ELIGIBILITY REQUIREMENTS

Wage Requirements - An individual must meet certain wage requirements to be eligible for temporary disability benefits.  This page provides the latest information.

Limitation of Benefits - In addition to wage and medical requirements, an individual must meet certain eligibility criteria.  This page provids a list of limitations.

Nonduplication of Benefits - In certain situations, the Temporary Disability Benefits Law requires that benefits be prohibited, or reduced because an individual is receiving some type of benefits for the same period of disability.  This page lists the types of situations which may be a bar to, or reduce benefits.


APPLYING FOR BENEFITS

How to Apply - Disability insurance is designed to serve you by mail.  You submit your claim by mailing the application for benefits, Form DS-1, to the Disability Insurance Office in Trenton.  By going to this page, you will find complete information on how to apply for benefits.

Calculating Benefit Amounts - This page explains how we calculate both your weekly benefit rate, and the maximum amount payable on your claim.

Cost - Both New Jersey workers and employers contribute to the cost of temporary disability coverage.  This page explains how to calculate the cost to the worker.

Pregnancy - If you are disabled due to pregnancy, you may be eligible for temporary disability benefits.  This page provides general information on how and when to apply for benefits.

Work Related Disabilities - If you have a work-related disability, and your employer's workers' compensation carrier denies you benefits or stops paying your workers' compensation benefits, you may be eligible for temporary disability benefits.  This page includes general information on filing a claim when you are faced with this situation.


AFTER APPLYING

Appeals - If you filed a claim for State Plan temporary disability benefits, and disagree with any written determination you receive from the Division of Temporayr Disability Insurance, you may file an appeal.  Go to this page to learn more about the appeal process.

Benefits Exhausted - If you are still disabled after receiving your maximum temporary disability benefits, there are other agencies which may be able to help you.  This page contains links to their websites.

Change of Address - If you move or change your mailing address after filing a claim for temporary disability benefits, you must notify this office in writing of your new address.  This page explains what you need to do when notifying us of a change of address, and where to send your written notification.

Contact State Plan Operations - This page provides information pertaining to the Division's Customer Service Section and the automated telephone system.

How Benefits are Paid - If you filed a claim for temporary disability benefits and you want information on how those benefits will be paid, the definition of a waiting week, or what you need to do to continue receiving benefits, this page provides general information on all of those topics.

Independent Medical Examinations - During the course of your disability, you may be scheduled for a medical examination by a State-appointed physician.  This page provides information about the process and your responsibilities should you be scheduled for such an examination.

Missing, Stolen or Damaged Checks - If you lose your temporary disability benefit check, or it is stolen, you must notify our office immediately so we can take the necessary steps to have it replaced.  This page explains what you need to do when notifying us of the lost, stolen or damaged check.

Tax Information - Provides information regarding federal tax withholdings from New Jersey temporary disability benefits.  Temporary disability benefits are not subject to the New Jersey State income tax.
